These Terms and Conditions govern your use of the Okumkom application ("the App"), provided by Food for All Mobile Technologies Ltd ("we," "us," or "our"). By downloading, installing, accessing, or using the App, you ("you" or "User") agree to be bound by these Terms and Conditions. Please read them carefully.
By using the App, you acknowledge that you have read, understood, and agree1 to be bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines or rules posted within the App. If you do not agree2 to these terms, you must not use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App3 on compatible devices for your personal, non-commercial use only, in accordance with these Terms and Conditions and the Google Play Store Terms of Service.
You may be required to create an account to access certain features of the App.
You are responsible for maintaining the confidentiality of your account credentials
and for all activities that occur4 under your account.
You agree to provide accurate, current, and complete information during the registration process and to update5 such information to keep it accurate, current, and complete.
You must notify us immediately of any unauthorized access to or use of your account.
We reserve the right to suspend or terminate your account6 at our sole discretion, without prior notice, for any reason, including but not limited to a violation of these Terms and Conditions.7
You agree to use the App in a responsible and lawful manner. You SHALL NOT:
Use the App for any illegal or unauthorized purpose.
Violate any applicable laws or regulations.
Infringe upon the intellectual property rights of others or us.
Transmit any viruses, malware, or other harmful code.
Attempt to gain unauthorized access to the App, its servers, or related systems.
Interfere with or disrupt the operation of the App or other users' use of the App.
Engage in any form of spamming, phishing, or other unsolicited communication.
Collect or harvest any personally identifiable information from other users without
their consent.
Use the App in a way that could damage, disable, overburden, or impair the App or our servers.
The App and its original content, features, and functionality (including but not limited to text, graphics, logos, images, software, and audio-visual content) are owned by Food for All Mobile Technologies Ltd and are protected by copyright, trademark, and other intellectual property laws.
You are granted a license to use the App as outlined in these Terms and Conditions. No rights, title, or interest in or to the App or its content are transferred to you.
You may not reproduce, modify, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as explicitly permitted by these Terms and Conditions.
The App may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photos, videos, and other materials ("User Content").
You retain all rights in and are solely responsible for the User Content you make available through the App.
By making any User Content available through the App, you grant to us a non- exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit your User Content in connection with the App and our business, including without limitation for promoting and redistributing part or all of the App (and derivative works thereof) in any media formats and through any media channels.
You represent and warrant that you have all rights necessary to grant the licenses in this section and that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, and publicity rights.
We have the right, but not the obligation, to monitor, edit, or remove any User Content that we believe violates these Terms and Conditions or is otherwise objectionable.
The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE APP. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Food for All Mobile Technologies Ltd, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO US FOR THE USE OF THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
You agree to indemnify, defend, and hold harmless Food for All Mobile Technologies Ltd, its affiliates, directors, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your use of or access to the App.
Your violation of these Terms and Conditions.
Your User Content.
Your violation of any third-party rights, including intellectual property rights or privacy rights.
We may terminate or suspend your access to and use of the App, in whole or in part, at our sole discretion, without notice, for any reason, including but not limited to your breach of these Terms and Conditions. Upon termination, your right to use the App will immediately cease.
We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms and Conditions within the App. Your continued use of the App after the posting of revised Terms and Conditions constitutes your acceptance of the changes. It is your responsibility to review these Terms and Conditions periodically for updates.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the courts located in Accra, Ghana, and you hereby consent to the personal jurisdiction of such courts.
These Terms and Conditions, together with our Privacy Policy and any other legal notices published by us within the App, constitute the entire agreement between you and us concerning the App and supersede all prior and contemporaneous communications and proposals, whether oral or written, between you and us with respect to the App.
